Lesson Terms & Conditions

These terms and conditions form the basis of the contract between Modelski Music and Customers. Customers are subject to and agree to be bound by these terms and conditions.

​

In these terms and conditions, the following definitions apply:

​

Modelski Music refers to the company which provides the music services, and includes the references ‘us’/’we’/’our’;

​

Customer refers to any individual to whom Modelski Music provides tuition. ‘Customer’ includes the parent/guardian of the Customer, where the Customer is aged under 18 years, and includes the references ‘you’/’yours’;

​

Lesson(s) refers to the instrumental/vocal/music theory lessons to be provided by Modelski Music to the Customer;

​

Student refers to the individual for whom the Lessons have been booked;

​

The School refers to the venue at which the Lessons are provided;

​

Teacher(s) refers to any services provider Modelski Music contracts to deliver Lessons;

​

Terms refers to the terms set out in this document;

​

Agreement refers to the contract entered into by the Customer to receive Lessons provided by Modelski Music in accordance with these Terms.

 

 

1. Changes to Terms and Conditions

Any changes to these Terms are valid only if agreed between Modelski Music and the Customer. From time to time, we may update these terms and conditions by sending you a notification of alteration. Should you choose not to accept these changes please notify us of your non-acceptance within 14 days of notification. Otherwise, the changes will take effect upon the expiry of the 14th day.

 

2. Lesson Costs & Payment Terms

Specialist one to one instrumental/vocal/music theory tuition is provided through 30, 45 or 60 minute lessons at intervals agreed upon by both you and The School.

 

Lesson fees from September 2023 for one-to-one tuition at our studio are as follows:

  • £20 for 30 minutes

  • £30 for 45 minutes

  • £40 for 60 minutes

Amounts may differ slightly for Lessons taught at other educational establishments. Full information will be provided where this is applicable.

Payment can either be made:

  • By the term, in advance;

  • Monthly in advance, spreading the cost of the academic year across twelve equal payments

 

Modelski Music reserves the right to refuse tuition where fees have not been paid in accordance with these Terms.

 

3. Cancellation

All Lessons are subject to a 48-hour general cancellation policy. Notice of cancellation should be given either by email to hello@modelskimusic.com, or by telephone message or text/WhatsApp to 07470324793.

If a Lesson is cancelled with less than 48 hours’ notice, or a student fails to attend, the Lesson is still chargeable.

Wherever possible, when appropriate notice of cancellation has been given, your Teacher will endeavour to reschedule the lesson to a date and time mutually convenient to both parties, within two terms of the original Lesson date. The School reserves the right to offer a lesson with an alternative teacher, where appropriate.

 

Modelski Music are under no obligation to provide rescheduled Lessons in the event of student absence due to sickness, holidays, school trips, exams, medical appointments or adverse traffic conditions, where the period of notification is less than 48 hours.

 

Where the student has taken ill on the day of the lesson and is absent from school or work, notice of student absence should be given at the earliest possible opportunity. In such circumstances and providing every effort has been made to give early notification of absence, your Teacher may offer a rescheduled Lesson where possible.

 

If your Teacher is unable to deliver a Lesson for any reason, every effort will be made to rearrange such Lessons within two terms of the original Lesson date. In the event that this is not possible, the cost of this Lesson will be deducted from your next invoice.

 

3.1. Cooling off period

In accordance with your statutory rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer may cancel the agreement to undertake Lessons during the ‘cooling off period’, which starts on the date a Customer registers the Student for lessons, and ends 14 days later. Cancellation must be received in writing or by email at hello@modelskimusic.com within the time period specified.

 

Should cancellation within the ‘cooling off period’ occur, the Customer is entitled to a full refund of any monies paid minus any fees for Lessons already delivered by Modelski Music. Unless otherwise agreed, such a refund will be made via the same method as used by the Customer to make the original payment.

 

3.2. Termination

We require at least one full half term’s notice of your intention to discontinue regular lessons. This can be given in writing, or by email to hello@modelskimusic.com.

 

4. Exclusion of Liability

Modelski Music does not accept liability for loss or damage to Customers’ instruments or personal possessions. It is your responsibility to arrange appropriate insurance for these items.

 

5. Behaviour

All Customers are expected to behave in a responsible and courteous manner within The School at all times and to attend Lessons regularly. Poor attendance, disruptive or anti-social behaviour may result in tuition being withdrawn with immediate effect. No refunds will be issued in such circumstances.

 

6. Safeguarding

Modelski Music is committed to the highest standards of promoting the welfare of children and adults and protecting them from harm at all times.

Modelski Music is committed to

  • Protecting children and adults who receive our services;

  • Ensuring that all members of staff are properly trained and supported in safeguarding;

  • Ensuring that all Teachers and staff have enhanced DBS clearance checks.

All staff have a responsibility to provide a safe environment in which individuals can learn. We recognise that some children, young people and adults may become victims of neglect, physical, sexual or emotional abuse and that Modelski Music staff, by virtue of their knowledge and contact with these individuals, are well placed to identify and report such abuse so individuals may be effectively supported as appropriate.

 

All staff are required to follow the Modelski Music safeguarding policy, which is in line with the Cheshire West and Chester Safeguarding Children Partnership safeguarding procedures. In addition, we will strive to ensure that all Modelski Music staff have access to appropriate training and briefings on a regular basis. To follow correct procedures is a statutory requirement, and failure to do so will be treated as gross misconduct.

 

7. Complaints

If you are dissatisfied with any aspect of the Lessons, level of customer service or our performance of this agreement, please send your complaint in writing to the School Director by email at hello@modelskimusic.com. Any determination made by Modelski Music arising from the Terms shall be final.

 

8. Data Protection

Modelski Music will use the Customer’s name(s), telephone number and email address (your Personal Data) to process your booking. We will only use your Personal Data in accordance with our privacy policy, which is available to view on our website.
